PROGRAM DESCRIPTION:

Objective: Construction contract specifications can usually be divided into four major components; the Instructions to Bidders, the General Conditions, the Special Conditions, and the Technical Specifications.  The General and Special Conditions are intended to define the rights and responsibilities of the Owner and the Contractor during the course of construction.  The objective of this session is to demonstrate methods of applying the contract sections in a responsible and effective manner.

Result:  Construction Management is as much a knowledge of laws, regulations, codes, and contract language as it is concrete and steel.  The Construction Manager is frequently called upon to make interpretations of complex contract issues using the General and Special Conditions.  This session will include discussions of common clauses, enforceability, and the practical application of the contract provisions.  Attendees will learn when notice provisions can be enforced, how to handle extended overhead cost requests, how to enforce liquidated damage provisions, and much more.

Who Should Attend:  Successful construction management includes maintaining good relationships and avoiding claims.  All those responsible for running a successful project or developing effective front-end documents will benefit from attending this session.

William L. Lacher, CCM, LEED®AP - As Vanir’s Southeast Regional Manager and a native of New Orleans, Mr. Lacher was a member of the founding team of the CMAA Gulf Coast Chapter. He also leads a Study Group for those committed to obtaining their Certified Construction Manager credential. Mr. Lacher has provided project controls, quality management, and claim avoidance and resolution services on significant construction programs including the Louisiana Superdome, the Trans-Alaska Pipeline, Moose Creek Dam, Hyperion Treatment Plant and the LAPD Headquarters facility.
